In obedience to a commission to us directed from the Honourable the Judges of the Court of Equity for the District of Salisbury & State of North Carolina, we have proceeded to take the deposition of MERRIL PHILIPS in a certain matter of controversy in said court defending wherein RIDGES Orphans by their next friend JONATHAN HAINS is Complainant & WILLIAM T. LEWIS & others Defendant.

This deponent being first sworn deposeth and saith that he is well acquainted with THOMAS RIDGE otherwise called THOMAS RIDGE MAGEE that the said THOMAS can neither read nor write, that he has often heard said THOMAS say that he was not in North Carolina from the commencement of the war with Great Britain until after the time of the battle of Kings mountain.

Sworn to and subscribed before us the subscribing justices of the peace for the county of Davidson and state of Tennessee at the court house of Nashville and State of Tennessee this 23'd day of August in the year 1804. In witness whereof we have set our hands and affixed our seals the date last above written.
