The Second Generation: Family of John S. Mintz, Margaret Young and Effie Wylie

John S. Mintz (b. 26 Mar 1841 - d. 22 Dec 1922). Born in Union County, SC  a son of John B. and Jane K. Mintz.

John S. married Margaret Young (b. 15 July 1836 - d . 25 May 1910).

After Margaret's death John wed Effie Wylie. They did not have any children.

John was socially active in his community and church. Historian Bobby G. Moss, writes in his book,"The Old Zion District" that John was elected to the office of Warden (town council) in 1889 for the town of Blacksburg, South Carolina. In 1923 John was ordained a Deacon of the Buffalo Baptist Church.

Effie remarried after John's death and moved to Tennessee. John is buried beside Margaret in the Buffalo Baptist Church Cemetery in Blacksburg, SC.

John and Margaret had three children:

William Mintz  (b. 1866) Born in York County, SC. William is believed to have died very young.

Augustus G. Mintz (b. Feb 1870)

Nancy Grace Mintz (b. 20 Oct 1876 - d 24 Oct 1965)

KNOW ALL MEN BY THESE PRESENTS, That I ----- John S. Mintz, being of sound mind and disposing memory, but mindful of the uncertainty of human life, do make, ordain, publish, and declare this to be my last will and testament: hereby revoking any and all wills or codicils heretofore made by me, to wit:

Item 1: It is my will and I so direct that any outstanding indebtness against my estate be paid out of my personal property by my executors hereinafter named.

Item 2: I do will, devise and bequeath to my beloved wife, Effie Mintz, the following personal property, to wit: My buggy and horse, one cow to be selected by her and all the house old and kitchen furniture, to her absolutely to use and dispose of as she pleases.

Item 3: It is my will and I so direct that all the rest and residue of my personal property be sold by my executors at public sale and the proceeds thereof, after taking care of Item 1 of this will, shall be added to the money I have in the Bank, and disposed of as set forth in the following items.

Item 4: I do hereby will, devise and bequeath that of the said money Three Thousand ( $3,000) to be placed in the First National Bank of Gaffney, S.C. by my executors hereinafter named; The income from the said money to be paid to my wife, Effie Mintz for and during her natural life or widowhood. In case of her remarriage or death the said money to be divided equally between my grandchildren, Dewitt Porter, Fred Porter, Gladsy Porter and Lurine Porter.

Item 5:  I do hereby will, devise and bequeath that One Thousand Dollars of the said money be invested in the said Bank, by the said executors and the income therefrom be paid to Eva Gaston. The said Executors are further directed to use so much of the principals of same as may be necessary in their judgment for her education and maintenance, the rest and residue of the said money to be paid her when she becomes 21 years of age.

Item 6:  I do hereby will, devise and bequeath that Two thousand Dollars ($2,000) of the said money be placed in the said Bank as the other funds herein directed and direct that my executors pay the income from same to my daughter, Grace Lavender, for and during her natural life; at her death the said money to be divided equally amount the said four grandchildren named in Item 4.

Item 7:  I do hereby will, devise and bequeath that all the rest and residue of the said money be placed in the same Bank on interest and direct that the income from same be equally divided among my wife, Effie Mints, and my daughter, Grace Lavender, or the survivor for and during their natural life, or the widowhood of my wife, Effie Mintz , or the survivor as the case may be; at the death of both of them said money to be equally divided among the said grandchildren named in Item 4 of this will; the interest of my wife in the said income to cease in case of her marriage again.

Item 8: In case there should not be money enough to take care of the devices in Items, 4, 5, and 6 amounting to $6,000 at the time of my death, then I direct that the rent from my land hereinafter disposed of be used by my executors until such deficiency is made up and there is that amount in the Bank to take care of those devises.

Item 9: I do hereby will, devise and bequeath that any real estate that I may own at the time of my death, except the 800 acres hereinafter devised, be sold by my executors at public auction and the proceed be placed with the other money in the First National Bank of Gaffney and become funds to take care of the devises hereinbefore set forth.

Item 10:  It is my will and I do hereby will, devise and bequeath that my farm consisting of about 800 acres, lying near Blacksburg, Cherokee Township, County and State aforesaid shall descend to my grandchildren, DeWitt Porter, Fred Porter, Gladys Porter and Lurline Porter, to them and each of them for and during their natural lives, the said land to be rented by my executors and be under their control for a period of ten years and the said income to be used by the said executors as to them seems best for the benefit of the said grandchildren; at the end of the said ten years, the said grandchildren to have control of the said place; on the death of the said grandchildren, the said said land to vest absolutely in fee in the children of the said grandchildren; the interest of any deceased grandchild having children to vest in those children, and the interest of any grandchild dying without children to vest in the children of the other grandchildren per stirpes. It is my will and I so direct that the said tract of land be held intact without division or sale in any manner whatsoever so long as any of the said grandchildren is living.

Item 11: In case the said Eva Gaston should die before becoming of age of 21 years that the money, then under the management of the said Executors, under Item 5, become a part of the other funds to take care of the provisions of Items 7 or 8.

Item 12: I do hereby direct that should any devisee or devisees herein named by any legal proceedings whatsoever take any steps to break the provisions of this will or contest same in any manner whatsoever, that any devise herein for the benefit of the said devisee or devisees shall become null and void and the said devisee have nothing whatever under this will.

I do hereby name, nominate, constitute and appoint R.P Roberts, Mrs. Grace Lavender, and John D. Wilson as executors of this my last will and testament, they to serve without being required to give bond.
