Easterling,
Pursuant to the CWA Constitution Article XIX, Section 1 (c),
(d), and (1), we wish to file charges against Mike Drake, GTE Unit
Vice-President. The background for these charges is as follows (see
attachments):
At the December 2, 1997 membership meting, a motion was made, duly
seconded and passed by the membership directing Mike Drake not to perform OPEIU
bargaining work. To the amazement of many that night, Mike Drake stood up and
said, "You can make as many motions as you want. I am going to do what I want
to do."
On January 26, 1998, the local was presented with yet another
grievance from Opal, Local 537. The issue was, after repeated directions not to
do so, GTE Unit Vice-President Mike Drake has continued to perform Opal work.
This is the latest in a series of incidents which has caused Local 9510 the
embarrassment of being grieved by its employees.
Beginning in February
1997 and continuing through to this latest incident, Mike Drake has persisted
in performing OPEIU bargaining unit work. Mr. Drake has had OPEIU work
precisely defined for him and willfully defies directions from the Executive
Board, as well as the Membership, and the Local President. The fact that a
union officer would so blatantly violate rights of another union's members
brings the local's very reason for existence into question.
Therefore,
we are filing this charge. We are charging Mr. Drake with willful violation of
Membership action, Executive Board direction and direction given by the Local
President.
As resolution we request that Mike Drake be suspended from
CWA for not less than five (5) years.
We file these charges in good
faith and swear that they are true and correct to the best of our
knowledge.
