No agreement - Step III. Not recommended for arbitration.

970372 (27402 Camino Capi) - Unjust 2-day suspension for attendance; disparate treatment.
No agreement - Step II. No further action taken.

970478 (2525 Orange-Olive) - Unjust 3-day suspension for falsifying time sheet.
Resolved - Step II. Grievant will receive 1-1/2 days' pay after one year from the date of the incident (8/5/97) if grievant goes without a similar violation.

970501 (200 C.S.P.) - Unjust warning of dismissal for attendance.
Resolved - Step II. Mgmt will remove 1 occurrence of 1 partial absence. If employee has another occurrence, then mgmt will look at the individual incident. The warning for dismissal will stand.

970516 (200 C.S.P.) - Unjust counseling for tardies.
Resolved - Step II. The employee has had no additional tardies since the incident and is currently satisfactory. Mgmt verified that a SIG alert occurred on the day in question. SIG alerts should not act as triggers for disciplinary action, but do count as occurrences. Mgmt agreed to track SIG alerts for the 4th quarter of 1997 to evaluate their continued use in occurrence counts. The counseling will be removed from the employee's file and the documentation destroyed.

Resolved - Step II. The employee has had no additional occurrences and is currently meeting standards. The counseling will be removed from the employee's file and the documentation destroyed.

Resolved - Step II. The employee has had 1 additional occurrence on 10/7, but is currently meeting standards for tardiness. The counseling will be removed from the employee's file and the documentation destroyed.

Resolved - Step II. Mgmt agreed to destroy the document in question. Both parties agreed that the document was not relevant to the case of the grievant's dismissal.

Resolved - Problem solving. Mgmt admitted to their failure; agreed to use techs for overtime from the OT schedule, and agreed to place unqualified techs on OT list and schedule by 12/5/97.

970744 (1472 Edinger) - Unjust 5-day suspension and documentation.
Resolved - Step I. 3/29/98, after perfect attendance - I day back; 9/29/98, after perfect attendance - 1-1/2 days back; at the end of May 1998, 30-day suspension warning is removed.

970750 (1265 Van Buren) - Unjust warning of suspension.
Resolved - Step I. Employee is now covered under FMLA with chronic conditions, and has been moved back to a counseling.

970779 (1472 Edinger) - Unjust removal of AX time; unjust mgmt request to have a written excuse by a doctor to approve excused time for medical or other reasons.
Resolved - Step I. Mgmt will allow 2% of total office head count for time off and for doctor appts. Grievant will be allowed 3 appts per month; no doctor's appt slips necessary.

970789 (1472 Edinger) - Harassment towards employees and unfair treatment.
Resolved - Problem solving. Mgmt agreed to count the date missed as pregnancy related to grievant's condition and will not ask for a doctor's note.

970790 (1472 Edinger) - Lost wages.
Resolved - Problem solving. Grievant understood there was no loss of pay.

970808 (507 Bush) - Disparate treatment; inconsistent administration of vehicle parking policy.
Resolved - Step I. Mgmt will provide paid parking at a private lot for headquartered employees at work location. Company lot will be first come, first served; 1 handicap; 6 company vehicle spaces.

970815 (1472 Edinger) - Mgmt forcing grievant to log on to company and phone 15 minutes before starting time.
Resolved - Step I. Mgmt will pay grievant 15 minutes overtime; grievant will not log on until start of shift.

Resolved - Problem solving. Mgmt agreed to grant AX time previously granted. Nonprecedent setting.

970820 (1472 Edinger) - Inconsistent administration of appointment time.
Resolved - Problem solving. Effective 1/l/98, appointment time is available all days of the month. The first and last days are not available.

970823 (1472 Edinger) - Unjust 5-day warning of suspension for tardies.
Resolved - Step I. Mgmt will remove the warning because 3 of the tardies were due to SIG alerts, and will bring grievant back to a counseling.

Resolved - Step I. In the future, if an employee has a steward of choice, mgmt will put counseling on hold to await for that steward, provided they're available.

970841 (1472 Edinger) - Mgr refused to help grievant with managerial responsibilities.
Resolved - Problem solving. Mgr agreed to help and take manager takeovers.
970843 (1472 Edinger) - Mgmt coded PDO incorrectly.
Resolved - Problem solving. After reviewing documentation, grievant was satisfied.

970844 (1472 Edinger) - Mgmt failed to provide clear vacation availability; mgmt failed to deal in good faith with grievant.

970858 (1452 Edinger) - Unjust counseling for tardies.
Resolved - Problem solving. Mgmt agreed to remove and destroy both counselings and documentation. Mgmt will follow contract in the future, and do so in a timely manner.

970859 (1472 Edinger) - Unjust denial of FMLA for absences.
Resolved - Problem solving. Mgmt agreed to cover the absences with FMLA, and CWA will inform grievant about FMLA within 2 business days upon her return to work.

970862 (200 C.S.P.) - Unjust documentation.
Resolved - Step I. Documentation will be removed 6/29/98.

970864 (200 C.S.P.) - Mgmt refusing to remove unjust counseling.
Resolved - Problem solving. Mgmt will remove the counseling and back date it to 11/9/97, when grievant became satisfactory. Mgmt will make amendment to documentation; follow up on 5/9/98 to remove and destroy the documentation if grievant remains satisfactory.

Resolved - Problem solving. Mgmt agreed to review year-to-date figures with only Oct, Nov, Dec, and reissue info to rep.

Resolved - Step I. Mgmt agreed to have occurrence as part of leave. Grievant will be satisfactory as of 2/13/98.

970819 (1997120022 - GTE - 7280 Bolsa) - Unjust 6-month memo for courtesy.
Resolved - Step 1. Mgmt will remove the memo on 3/3/98 if no further violations.

980001 (200 C.S.P.) - Mgmt denying shift change of one-half hour.
Resolved - Step I. Mgmt will allow the canvass to take place to allow employees with higher NCS to choose desirable shifts.

980005 (200 C.S.P.) - Unjust warning of dismissal.
Resolved - Step I. If grievant maintains perfect attendance until 4/l/98, mgmt will remove the warning of dismissal.

980023 (1472 Edinger) - Denial of unscheduled paid time off when open on calendar.
Resolved - Problem solving. Mgmt agreed to change the unpaid FMIA day on 1/6/98 to a PDO.

980024 (1472 Edinger) - Denial of unscheduled paid time off when open on calendar.
Resolved - Problem solving. Mgmt agreed to change the unpaid FMLA day on 1/7/98 to a PDO.

980026 (1472, Edinger) - Payroll error and notification of error to grievant's pay period.
Resolved - Problem solving. Grievant was compensated 1/6/98. In the future, mgmt will handle this issue in a more timely manner.

980035 (200 C.S.P.) - Unjust warning of suspension for negligence.
Resolved - Step I. Warning will be removed and replaced with a training lead documentation. Said documentation will be removed on 4/5/98.

980040 (1472 Edinger) - Overtime bypass.
Resolved - Problem solving. Mgmt will show grievant starting at 8 a.m. and will grant the grievant overtime.

980041 (1472 Edinger) - No coach, no R.D., no mgr available, customer returns, rep expected to do all roles.
Resolved - Problem solving. (1) If mgr not available, an R.D. will be available for questions and t/o; (2) mgrs will have pagers with them with whereabouts written on the chalk board.

980042 (1472 Edinger) - Failure to give stewards their releases; failure to plan union time into schedule causing poor adherence results.
Resolved - Problem solving. (1) Union rep's 9/97 and 10/97 adherence will not count; (2) All stewards will get their releases in their mail bins daily; (3) In-charge will in-put keys ahead of time; (4) Stewards will get 15 minutes' travel time for "in-house" meeting; (6) Schedules will be posted daily.

Resolved - Problem solving. Mgmt will reinstate 15 minutes OT, to be used to go through in-basket screening and voice mail. Mgmt agrees to communicate this to grievant, will also inform mgr to advise entire office via desk drop.

980050 (3925 Coronado) - Inappropriate behavior towards grievant with disability.
Resolved - Problem solving. Mgmt agreed to provide one-to-one training in the future if grievant requests. Mgmt understands grievant's situation and is will to accommodate her needs.
