Inferior Court of Milton County
For County purposes met this 23rd day of March, AD 1858. Present their Honors Isham Teasley, John W. Nesbit, A. A. McMakin, Tho. W. Mayfield C. G. Gillespie.

Ordered that the County site be and the same is thereby permanently located and fixed upon lots of land Nos 1252 & 1253 twelve hundred & fifty two & twelve hundred & fifty three in the Second District of the Second Section of originally Cherokee now Milton County.

At Chambers March 23rd 1858, we the Justices of the Inferior Court in & foresaid County order that said County be organized and laid out into militia districts by the following meets & bounds,
towit all that portion of Milton County south east of Vicorys Creek and north east of the State Road is one district called Miller's District. All that portion south east of said creek & south west of said road is one district called New Town District. One district called Town District commences the west line of lot of land No 577 of the 1st District & 2nd Section thence north to Cooper Sandy creek, thence up said creek last aforesaid to the fork of said creek, thence up the right prong to the Forsythe line, onto the end of said prong, thence due east to the Forsythe line, thence south along the Forsythe line to the corner of Forsythe, thence east along the Forsythe line to Vicorys Creek, thence down said creek to the mouth of Martins Mill Creek, thence up said last mentioned creek to the east line of said lot aforesaid, all that portion of Milton west of Vicorys Creek & south of the old line between Cobb & Cherokee Counties, except that which is included in the Town District is one district called Hammons District

- all that portion north of said old line between Cobb & Cherokee and west of said Town Dist & south of Cooper Sandy Creek is one district called Little River District, and all that portion north of Cooper Sandy Creek and said Town District is one District - Double Branch District.

And it is ordered that said County of Milton be organized as above indicated and that said County of Milton is organized after the manner above mentioned.

Aprile the 12th 1858
The Court haveing reconsiderd the order passed on the 23d day of March 18, 1858, for the location of the Court House have thought proper to change the location on site for the Court House in the County of Milton and do now order and determine that the same shall be permanently located on lots of land numbers 1268 and 1269 in the 2d district of the 2d section of originally Cherokee now Milton County, and it is further ordered by the court that William Young, the County surveyor do preced to survey and lay off the public square and lots in said town, and it is further ordered the clearing up and cleaning of the streets and lots in said town, and be let out to the lowest bidder. It is further ordered that lot no 1269 be

purchased by Court for the purposes aforesaid.
And twenty acres of lot no 1268, it being west half of said lot, and it is further ordered that the lots in said town be advertised for sale to be Sold on the 28th day Aprile 1858 - said sale to continue from day to day. Said lots to be sold to the highest bidder at public out cry At a meeting of the Infr Court on the 30th Apr and first days of May 1858 the town lots haveing been disposed of according to previous order, the following is the amounts for which they were sold:

A Plan for the Jail
The house shall be 22 by 26 feet. The wall shall be of logs 12 inches thick. The basement wall shall be of rock resting on a clay foundation, 18 inches above the surface of the ground. The sleepers for the first floor shall be 3 by 10 inches. The first story to be 8 feet from floor to ceiling. The sleepers for the second floor to be 6 by 10, not exceeding 6 inches apart. The second story to be 8 feet from the floor to the ceiling. The joists to be 6 by 10 & not exceeding 6 inches apart, and to extend over the wall 18 inches. The house shall be covered with heart pine shingles shaved to have two feet eve or drip. The floor of the 1st story shall be of good pine plank 1 1/4 inches thick to be dressed & laid in workman stile. The first story shall be ceiled over head with common ceiling. The floor of the second story to be laid with oak plank two inches thick. The over head ceiling of the second story to be of oak plank two inches thick - both to be nailed with 20 penny nails. The second story to be cut a cross with two partitions walls of logs 12 inches thick leaving a passage of four feet, making the debtors room 12 feet, the other 10. On the criminal room shall be pinned to the wall oak scantling 5 inches square, one pin in every log, half of the pins pointing down and the other up. The scantling to be not exceeding two feet from

from center to center and to be all round said room. Said room to be ceiled with oak plank two inches thick, put on with 20 penny nails. Between the wall and ceiling to be well filled with gravel. The debtors room to be ceiled all round with oak plank two inches thick and nailed to the logs with 20 penny nails. The criminal room shall have two windows 4 feet wide & 10 inches high to be filled with greats of one inch square bar of iron barely one half inch a part, shall have one door two feet wide & four feet high with a substanch frame closed by two shutters, one opening on the inside, the other out. The shutters shall be made of oak plank two inches thick doubled spiked together. The inside shutter to be covered with sheet iron, leaving a hole through the shutter of 6 by 8 inches, four feet from the floor. The shutters shall be hung with large wrought iron hinges, the inside shutter to be fastened with a large bolt, the out side shutter with a good stock lock. The debtors room shall have two 8 light windows to be substantially greated with bars of iron crossed every four inches and riveted. The Windows shall have sash & glass. The door shall be 3 by 6 feet. The shutter to be of oak plank two inches thick, well spiked to be hung with large iron hinges fastened with a good stock lock. The first story to have two doors with good common shutters. There shall be a stair way leading to the passage above. There shall be one good chimney of brick with

a fire place to the first story.

Whereas on the twenty eighth day of April 1858, in accordance with previous notice the building of a jail was offered to the lowest bidder, and James A Stewart being the best & lowest bidder, it was cried off to him at the sum of one thousand & four dollars. Now be it known that the said James A Stewart and his securities, towit A M Stewart, R E Sherman, J J Stewart and J L Stewart are held & firmly bound unto the Inferior Court of Milton County viz Isham Teasley, C G Gillespie, John W Nesbit, Alexander A. McMicken, and Thomas W. Mayfield, who constitute said Court in a bond of one thousand and four dollars, the true payment of which we bind ourselves, our executors, administrators, heirs and assigns.
Now the condition of the above bond is such that if the said James A Stewart shall well & truly build a jail house at Milton in Milton County on such a site as the Court may direct and build in accordance and with the written plan and specification and diagram

accompanying this bond and complete the jail by the first day of December next then this bond to be null & void. Otherwise to remain in full force & virtue and the above named Inferior Court or their sucessors in office do pledge the faith of the said Milton County to pay the said James A Stewart one thousand & four dollars for the building of the said jail house, five hundred dollars to be paid when the wall is up and cap joists on them, and the remaining five hundred and four dollars to be paid when the said jail house is completed. 18th day of May 1858

Rogers, and Bradford Williams be and they are hereby appointed reviewers to review said road, a true return thereof to make to the Inferior Court of Milton under oath. Howells Ferry

Return of Road reviewers this June 29th 1858 to the honorable Inferior Court we the undersigned reviewers appointed by your honorable body to review and lay out a road from the County cite to McAfees and Gregorys bridge by the way of new Town post office after three days of labor beg leave to make the following report from the County cite the the house of R. L. Haynes thence through said Haynes Lands to the big Creek crossing the Creek on lot no 757 at the line fence through the lands of J. W. Morris by the residence of John A Jones thence directly to New Town all of said rout you will find marked and don't believe will vary in any place Two hundred yards from a strait line from new town we intersect the McAfee road to Lebannon mills at the old place this 29th June 1858.

Inferior Court inssion Present their honors Isham Teasley, John W. Nesbit and Thomas W. Mayfield. Ordered that so much of the State Road as is hereafter mentioned is not to be kept up by hands of the district from Lawson Fields to the Blacksmith Shop near D. W. Devore, but the road from the said Fields runing by J. S. James and intersect at the afforesaid Shop to be kept up in lieu of the other. This the 29th June 1858

plan for curbing & covering the well in the Town of Milton. It is to be curbed with sound post oak timber one foot square. The curb frame to be three & a half feet square in the inside and the curb timber of such length as that a frame to hold a windless may be placed upon it at a suitabele distance from the center of the well, the wind less 12 inches in diameter. Iron gudgeons framed into pieces 4 x 6 inches dufftailed into the curb timber Iron Crank, the box 4 feet square, 3 feet high falling shutters Iron hinges, entrance 18 inches square, the well to coved with a selter 12 feet square, sills of the the shelter to be sound post oak timber, 12 inches

square, to be well framed together, corner posts 8 inches square, 8 feet long, b***es 4 x 6 inches, plates 6 x 8 inches, a hip roof, principle rafters 4 x 6 inches filled with 3 x 4 to be 2 feet apart, the crown blck 6 inches square, to be extended 5 feet down pully wheel, to be hung to the crown block, the rafters closely sheeted and covered with good heart pine shingles, the foot of the rafters to extend one foot over the plate and to be neatly boxed, the out side seals are to be 4 or 5 inches lower than the co**t, and to be well floored with one ***** heart inch plank laid down in high stile tongued and grooved, all well dressed box inducted end of floor to extend 3 inches over the seals to be supplied witht a good Iron bound bucket and a one inch cotton rope, all to be furnished in neat stile. It appearing to the Court by the petition of a number of respectable citizens of Milton for a road from the town of Milton running the nearest and most practicable route to intersect the Marietta road and the store of P. F. Rainwater, now ocupied at Cherokee line P O that said road will be of great utility. It is therefore ordered by the Court that Abel Crysler, John W. Morris, J. A. J. Sate of Inferior Court in session July 20, 1858. Present their honors Judge Thomas Mayfield, John W. Nesbit, it appearing to the Court upon satisfactory evidence that John J. Stuart has had two attachments issued against the property of Alonzo D. Martin and it further appearing to the Court that said attachments has been levied upon property of a perishable nature and likely to deteriorate in value and that there is expense attendant upon keeping the same, it is therefore ordered upon motion that the property levied upon by said attachment be exposed to sale by the sheriff or his lawful deputy upon Tuesday the 3rd day of August next and it is furthur ordered that said sale be published at Alpharetta the situation of the Court house and at two other public places in said county at least ten days before the time designated for said sale. Specification of brick work and plastering for Court House in Milton

The house to be 44 ft by 56 ft out to out foundation is to commence on a good clay 3½ bricks thick & to diminish gradually to 2 ½ brick where the Sleepers rest, the first story to be 2 bricks thick and ten feet high from floor to ceiling, the 2nd story 1 ½ brick thick 14 ft from floor to ceiling - two inside walls running lengthwise through the house to start 2 bricks thick dropped at sleepers to 1 ½ brick & to run one story high. There shall also be pilasters to the house about 4 of a side. there shal be 4 colums, two largest to receive the projecting roof - 2 small ones to hold up the platform - the 2 large columns to 2 ½ ft at the base - the small ones about 18 in. There shall be 4 chimneys inside and fire places - the brick for foundation and outside to be hard burnt - the brick all to be laid in good Lime Morter & penciled - the inside walls of the whole building to be plastered with a good white wash finish. To the honorable Inferior Court the petition of John Morris showeth that Sylvester Nesbit, R. L. Haynes, William H. Autrey, William H. Scott, et alias who were appointed to review and lay off and set out a suitable location for a road runing frorm the Town of Milton to a place known and distinguished as new Town which said commitioners or reviewers proceeded as from their report with move fully *** rear to lay out and locate said road and in so doing have conducted and laid off and located that portion of said road which passes over the land and possessions of your petitioner in such manner as to greatley aggrieve, injure and damage your petitioner by locating said road so far as the same is upon the enclosed land of your petitioner in such manner so as to divide the farm of your petitioner lengthwise by reason of which your petitioner will be if your honors should grant said road compeled to make and keep up two very long strings of fence and by reason of which the lands of your petitioner will be greatly deterioated in value wherefore your petitioner prays that your honors may issue a warrant directing the sheriffe to summons a jury of freeholders to assess and determine the damages resulting to your petitioner by reason of said road being laid off and located as aforesaid and requireing the said sheriff to make a true return of the actings & doings of himselfe and said jury summoned as afforesaid to the next term of the Inferior Court and to take such futhur action the premeces as your honors may deem

1858 Aug 13th Inferior Court met present their honors Isham Teasley, John W. Nesbit, Caleb G. Gillespie, Berry Gay claiming to be a free persons of color was brought before the court and arraigned for trial having been arrested by Hampton Smith a L. C. for a violation upon a warrant charged with a violation of the registry Laws of Georgia - both parties having announced ready the following brief of testimony was submitted.
(For the state) Jno. L. Moore sworn ***p - that Benny Gay applied for registry as a free person of color on the fifteenth of April last - that the said Moore being clerk of the court laid the matter before the Inferior Court where sitting - that he also previous to this time ganted the said Berry Gay a certificat of application - that said Court when sitting for County

purposes refused to permit said Berry Gay to be registered on the grounds that he the said Berry was of bad character - deponent further says that the said Barry Gay gave him fifty cents for the certificate of application which he granted the said Barry and also the said Barry Gay wrote a note for two dollars more & threw it down before witness but witness refused to take it - deponent understood the court judicially to determine that the said Barry Gay could not be registered - don't know when Gay left Milton County - thinks it was in May 1858. The last time Gay came to the house of witness he - (witness) told him (Gay) that the Inferior Court had refued to allow him (Gay) to be registered - state closed - (Testimony for the defendant)
John W. Morris - sworn said - that Berry Gay left Milton County about the 25th of May 1858. Gays family left between the twenty fifth & 30th May - Witness never saw Gay out of Milton county & dont know that he was out of it only he has heard respeable people say so.
GM. W. Robbins sworn - says that Gay has been has been a resident of Gwinnett since sometime in May. *** (Gay) & family came to Gwinnett

sometime in May - witness is not interested in getting Gay out of this scrape - is acting as Guardian Agent for Gays Guardian - has written authority from said Guardian - does not expect to get any pay for coming here -
It was admitted by counsel for the state that Berry Gay has a legal Guardiane in Franklin County in the state of Georgia.

After argument by counsel the Court decided that defendant was in violation of the registry laws of this state & was guilty of **** in violation of said laws in said county - no judgement or decision of the court was reduced to writing but was merely oral. The court postponed passing sentence against Gay till the next morning following and then adjourned over to that time.

Aug 14th 1858
The court met pursuant to adjournment present their honors Isham Teasley, Caleb G. Gillespie & John W. Nesbit, Columbus Allen claiming to be a free person of color was arraigned before the court being arrested

under a warrant for a violation of the registry laws of this state. The defendant announced not ready and after making his showing for continuance the Court granted him a continuance till the fourth Mona\day in this month. (August)

Pollyann Allen Julian Allen claiming to be free persons of color and Cynthia Allen, being arraigned before the court for trial having been arrested on a warrant for violation of the registry laws of this state likewise made a showing for continuance which was granted by the Court **** the 4th Monday in this month. Counsel for the defendant presented to the Court certain exceptions in writing which the Court declin** the decision of the Court in the case of the state vs V. S. Berry Gay which the Court declined to sign not having passed sentence against the said Gay. The Court then adjourned.

informed to the honorable Inferior Court that Robert Martin has fraudulently returned his property to the Tax Receiver in this to-wit that he has returned No. 34 slaves at the value of $12,000 dollars, when thiy are really worth and aught to have been given in at $20,000 dollars, their true valuation that he is possessed of land to the value of $8,000 dollars as has fraudulently returned the same as $5000 dollars, all of which is contrary to the laws of said state and hereby and action hath accrued to the County of Milton. Wm H. Autrey vs. J. D. Tuck. CaSa &C in Milton Inferior Court Sept Term 1858. It appearing to the Court that John D. Tuck the defendant in the above stated case has notified W. H. Autrey the creditor at whose instance he was arrested according to law and he the said John D. Tuck haveing taken & signed the oath prescribed for the relief of insolvent debtors by leave of the court first obtaind for that purpose being moved thereto by the said J. D. Tuck, it is therefore ordered by the court that said defendant J. D. Tuck be & he is hereby fully discharged from his said arrest and from all liability on said CaSa and that John L. Moore Clerk enter the proceedings in this case upon his minutes. Sept 6th 1858.

Tuck do solemnly swear in the presence of Allmigty God that I am not possessed of any real or personal estate debts, credits or effects, securitys or contacts whatsoever my wearing apparel, beding for myselfe and family and the working tools and implements of any trade on calling together with the nesessary equipments of a militia soldier except other than are mentioned in the schedule now delivered and that I have not directly or indirectly since my imprisonment or before sold leased or disposed of or otherwise disposed of or made over in trust for myselfe or otherwise any front of my lands estates goods stock money debts securities or contracts whereby any money may hereafter become

James M. Seale vs. James E. Jones CaSa ** Milton Inferior Court Sept Term 1858. The defendant James E. Jones having been delivered in the court by J. W. Morris his security and having failed and refused to notify his creditors according to law and to make it appear to the Court that he has give the necessary notice to the creditor James M. Seale at whose insistence he was arrested and there being no jail in this county it is therefore ordered pursudent and adjudged by the court that he the said James E. Jones be imprisoned in the common jail in Forsyth County until a full and fair disclosure of all the property money and effects be made by him, the said James E. Titles to build calaboose

We Isham Teasley, Caleb G. Gillespie, John W. Nesbit & Thos W. Mayfield justices of the Inferior Court in and for said County do agree with the town commitioners of Alpharetta in said County that they do build a callaboose on the jail lot in said town and warrant them and their successors in office the peaceable possession of said callaboose until such time as the County of Milton shal sell the lot and then the commitioners shall have the rite to move said house as they have at any other time this 21st day June 1859.

Bridge Bond
Know all men by these presents that we Richard Haynes & Arthur T. Camp security are held and firmly bound unto the justices of the Inferior Court in the sum of two hundred dollars for the true payment of which sum to the justices of the Inferior Court and their successors in office we bind ourselves our heirs executors and administrators jointly and severally firmly by these presents sealed with out seals and dated this the twenty first day of June eighteen hundred and fifty nine. The condition of the above obligation is

such that if the said Richard Haynes shall build a good and substanchial bridge across Vickorys where the road crosses said creek leading from Alpharetta to McAfees and Gregorys Bridge the frame of said bridge shall be of good sound hewed timber of sufficient size covered with sound quartered plank with good and sufficient bannisters the said bridge shall be kept in good order and in safe condition for the term of five years from the time of completion, said bridge to be completed by the fifteenth of September next then this bond to be null and void otherwise to remain in full force for which we the justices of the Inferior Court bind ourselves and our successors in office to pay Richard L. Haynes the sum of one hundred dollars upon completion of said bridge signed and sealed in presence of J. L. Moore CIC the day and date above written

Whereas there is a matter of controversity in regard to the road leading from Ebenezer Church to the Cobb line by way of John A. Youngs sawmill which order was granted August 31st 1858, the court having examined the road and think it not of publick utility it is therefore ordered that the order makeing said road a publick road is hereby recinded and ordered that said road be kept open as a private neighborhood road September 12th 1859.

Inferior court in special session July 12th 1860 on the petition of Evan Howell and others therefore it is ordered that Jesse Brown, William Anderson, R. M. Autrey be and they are hereby appointed commissioners to review the old road leading to Warsaw Ferry and the road leading to Evan Howells Ferry from where they fork in this County and report to this Court as to the propriety and utility of changeing the road leading to the said Old Warsaw Ferry from said fork so as to lead to the present ferry of the said Evan Howell and it is further ordered that said commitioners report thereon to this body as soon as convenient.

Petition of Evan Howell & others &C to the honorable the Inferior Court the undersigned respectively represent that the ferry formily known as Warsaw Ferry across the Chattahoochy River between this and Gwinnett County has been discontinued that Evan Howell of Gwinnett County has purchased the landing in that

County and removed the ferry boat chain &C down said River about three hundred yards below the old Warsaw Ferry and that he has a public ferry at that place regularly kept and in good order for the accommodation of the public there new being no public utility for keeping open the road leading to the said old Ferry the undersigned respectfuly pray your honors in special session to pass an order appointing three commitioners as the law provides in such casses to review the road leading to the said Warsaw Ferry and the one leading to the present Ferry of the said Evan Howell and to report to your honors the propriety of changeing the said road from where they fork in said County of Milton leading to said ferries so as to turn the said old Warsaw Ferry road by the said ferry of Evan Howell as the same now runs and should such commitioiners report favorably there to your petitioners pray that the road afforesaid be so changed as aforesaid and your petitioners will ever pray &C July 1860. We the within apointed reviewers having taken in to consideration the matters therein named to wit the propriety of changeing the old road running from H. W. Howels to the old Warsaw Ferry to the Ferry now kept by Evan Howell on the Chattahoochee about 300 yards below the old Ferry beg leave to submit the following report.
1st we find that there is no Ferry boat kept at the old ferry land and the road leading there is of little or no utility 2nd we find the road leading to Warsaw Ferry in good order the Ferry well kept and the traveling public properly accommodated, 3rd we do therefore recommend that the road leading to the old ferry be so changed as to run by said Howells Ferry - all of which is respectfully submitted

The Undersigned members of the Inferior Court of Milton haveing this day taken into consideration the petition and also the report of the reviewers upon the subject matter of changeing the old road leading to Warsaw Ferry to the Ferry now kept up by Evan Howell and said reviewers having been appointed and qualified acording to law and haveing duly made their report to this body which report recommends the romoveal or change in said road as afforsaid it is therefore ordered by the Court that said old road leading from A. W. Howells to the old Warsaw Ferry be so changed as to run from the **** H. W. Howells to the Ferry now kept up by Evan Howell commencing said change where the road now forks near the residence of H. W. Howell that said old road be abolished and **** said new road b e established instead thereof.
Registered this 16th July 1860. Order granting said road

In special session August 18th 1860 it being represented to the court by the return of the reviewers properly appointed for that purpose, that a change in the Stage road leading from Marietta to Alpharetta will be of public utility. It is ordered that said road be changed as follows, commencing near a certain patch near where B. Thompson lives and running to the Creek about four hundred yds from the present ford and running thence with the old road near Mr. L. C. Dempseys residence provided that said change is not to take effect til said new road is made in good trarding order by E. P. Camp who has agreed to open & work out said road.

Inferior Court in session August 20th 1860 upon the petition of Mastin Wells(Wills) & others it was ordered that Henry W. Parris, John S. James, Hampton Smith, Joel Rucker, J. W. Johnston be appoint to review two roads or routs from this place to Mastin Wells(Wills) Lane one of the routs runing by David Morris and the other by Mr. Bowens.and report at an early day as practible

To the Inferior Court the undersigned appointed for the the purpose of reviewing the roads runing from Alpharetta to Mastin Wells (Wills) Lane have performed the duty assigned them. They find that the contemplated road will be one of much publick utility and convenience they proceeded to lay out said rout as follows from Alpharetta the back road to David R. Morris thence to John Dodds and after crossing the branch byond said Dodds thence the County line as near as practicable to Willilliam Martins by William Morris thence to the northwest corner of said Martins field thence by his house and wuld recommend
