The petition of Tabitha Dupuy, for herself and children, a resident of Walker County, Texas against Jonathan A. Dupuy, a resident of the state of Arkansas.
To the Judge of the 7th Judicial District of the State of Texas.
Your petitioner, Tabitha Dupuy would state that in 1836 she intermarried with Jonathan A Dupuy in the State of Alabama with whom she lived for some five years, having issues by him two children, to wit, Martha and James now minors and having petitioned as their natural guardian.
She further states that as the end of said time of years that said Jonathan A. maliciously & willfully abandoned her & has since so continued to desert and abandon her and afterwards married another woman, with whom he was living at last account in the State of Arkansas. So that petition charges said Jonathan A. with willful desertion and abandonment for nine years without any good causes & with adultery. She further states that in behalf of her children who she prays may be regarded as petitioners with & by her as their next forsaid & natural guardian, that said J.A. Dupuy left in her possession a negro boy named Davy, now about 25 years old, who is still in her possession. She further states that after her said husband's desertion as aforesaid, she remained with her father Jesse Evans & her children to this county where she has resided for nine years.
For promise and consideration she prays in her on behalf and that of her children, that said Dupuy be made defendant hereto, that he be cited by publication and that court will hear proof of and decree a final divorce action between herself and her said husband, and also that said boy Davy be set apart for the support of said James and Martha Dupuy and such action and future relief as may be lawful and right.
