ALLEGATIONS OF NAVAL REACTORS FALSIFICATION

NYSDEC PASSES BUCK TO FEDERAL EPA

A letter identical to that sent to NYS Attorney General Elliot Spitzer (dated May 18, 2001) about KAPL's obvious falsification of its landfill CERCLA rating was sent to Governor Pataki. Such letters are no longer sent to NYSDEC because over the past several years their statements and actions clearly demonstrate that they have no interest in meeting their responsibility of providing oversight of the Knolls Laboratory. Therefore, we no longer waste our time trying to deal with a worthless state agency. However, Governor Pataki does routinely forward such letters to NYSDEC for an official response. In this case, NYSDEC, like Attorney General Spitzer, apparently finds the potato too HOT to handle.

Governor Pataki has asked me to reply to your recent letter concerning your allegations that the Knolls Atomic Power Laboratory (KAPL) submitted falsified information to the United States Environmental Protection Agency (EPA) which was incorporated into the hazard ranking scoring (HRS) calculations for the Knolls Site Land Disposal Area in 1988. The Department of Environmental Conservation takes these allegations seriously. We are reviewing the information that you have submitted and have also forwarded your letter to EPA for their consideration.
