Two legal arguments by the APS opposing the Calhoun suit in March 1958:
1. The defense
said that the "parents hadn't exhausted the administrative
remedy provided by the laws of Georgia, and had not gone before
the Board of Education or appealed from adverse action of that
board to the state Board of Education and thus had not followed
proper procedure."
2. The 10 parents, according to the motion, had no right to represent
40,000 Negro children in Atlanta and 1,200 teachers who had not
shown that they favored the suit.
